Terms of Service

These Terms of Service ("Terms") govern the services provided by Commonwealth Industries LLC, doing business as Shoalwater Digital ("Shoalwater Digital," "we," "us"). By using our services, you agree to these Terms.

1. Services

We provide domain registration, email hosting, web hosting, and related services as described in your service agreement or order. Specific terms, fees, and service levels for each client are set out in that agreement.

2. Domain Registration

Domain registrations are also subject to the policies of the applicable registry, our upstream registrar, and ICANN, including the Uniform Domain-Name Dispute-Resolution Policy. You are responsible for providing accurate registrant contact information and keeping it current.

3. Client Responsibilities

You are responsible for the content you host or send through our services, for keeping your account credentials secure, and for complying with our Acceptable Use Policy and applicable law.

4. Fees and Renewal

Fees, billing terms, and renewal terms are set out in your service agreement. Services, including domain registrations, may lapse if renewal fees are not paid on time.

5. Suspension and Termination

We may suspend or terminate services that violate these Terms or the Acceptable Use Policy, that pose a security risk, or as required by law or by a registry or registrar. Either party may end services as described in the service agreement.

6. Data and Backups

We take reasonable steps to protect and back up the systems we operate, but you remain responsible for keeping your own copies of important data.

7. Disclaimer of Warranties

Services are provided "as is" and "as available." To the extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We do not guarantee uninterrupted or error-free service.

8. Limitation of Liability

To the extent permitted by law, our total liability for any claim relating to the services is limited to the fees you paid us for the affected service in the [12] months before the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost data.

9. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law rules.

10. Changes

We may update these Terms from time to time. The current version is always posted on this page.
